Returns and Refunds Policy

This Returns and Refunds Policy applies to all purchases made on our online store, operated by Manuel Rodriguez, trading as "Tekko Fitness". It is structured so as to comply with consumer protection laws in the European Union (including Italy), the United Kingdom, and the United States of America. Where mandatory consumer rights apply in your country of residence, those rights prevail over any inconsistent provision of this policy.
1. 15-Day Commercial Return Policy (All Customers)
We offer a 15-day return policy: you have 15 days from the date you receive your item to request a return.
To be eligible for a return, the item must be:
- in the same condition that you received it;
- unworn and unused;
- with all original tags attached;
- in its original packaging;
- accompanied by the receipt or proof of purchase.
This 15-day return window is granted on a contractual basis and is in addition to any statutory rights you may have under the laws of the European Union, the United Kingdom or the State in which you reside (see Sections 4, 5 and 6).
To start a return, contact us at tekkofitness@outlook.com, including your order number and the reason for the return.
Returns must be shipped to: Manuel Rodriguez — Tekko Fitness, Via Bernardo Strozzi 9, 16136 Genova (GE), Italy.
If your return is accepted, we will send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.
2. Damaged, Defective or Incorrect Items
Please inspect your order upon delivery and contact us immediately at tekkofitness@outlook.com if the item is defective, damaged, or if you received the wrong item.
If the item is found to be defective, damaged in transit, or not as described:
- return shipping is at our expense;
- you are entitled to a full refund, replacement, or repair, in accordance with your statutory rights (see Sections 4, 5 and 6 below).
This applies regardless of whether the 15-day return window has passed, to the extent that statutory rights so require.
3. Exceptions / Non-Returnable Items
The following items cannot be returned, except where they are defective, damaged or not as described:
- Custom-made or personalised goods (made to your specifications or clearly personalised);
- Sealed goods unsealed after delivery that are not suitable for return for hygiene or health protection reasons (e.g., mouthguards or other items in direct contact with the body);
- Gift cards;
- Digital content that has begun downloading or streaming with your express consent (UK/EU only).
Note: Items purchased on sale or as part of a promotion are NOT excluded from your statutory rights of cancellation in the EU and UK and may be returned under the same conditions as full-price items.

4. Additional Rights for European Union Consumers
If you are a consumer resident in the European Union, you have the following statutory rights, which apply in addition to our commercial 15-day return policy.
4.1 14-Day Right of Withdrawal
Under Articles 52 and following of the Italian Consumer Code (Legislative Decree no. 206/2005), implementing Directive 2011/83/EU, you have the right to withdraw from this contract within 14 days without giving any reason. The 14-day period begins on the day you (or a third party other than the carrier indicated by you) acquire physical possession of the goods.
To exercise this right, send us an unequivocal statement (by email or post) before the 14-day period expires. You may use the model withdrawal form in the Annex, but it is not mandatory.
You must return the goods within 14 days of communicating your withdrawal. You will bear the direct cost of returning the goods, except where they are defective or not as described. You are only liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
We will reimburse all payments received from you, including standard delivery costs, within 14 days of being informed of your decision to withdraw, using the same means of payment used for the original transaction. We may withhold the refund until we receive the goods back or until you provide evidence of having sent them, whichever is earlier.
4.2 Legal Guarantee of Conformity (2 Years)
Pursuant to Directive (EU) 2019/771 and Articles 128 and following of the Italian Consumer Code, the goods you purchase are covered by a legal guarantee of conformity of two (2) years from delivery. If the goods do not conform to the contract, you have the right to repair, replacement, a price reduction or termination of the contract under the conditions set out by law. This statutory warranty cannot be excluded or limited.
4.3 Online Dispute Resolution (ODR)
In accordance with Regulation (EU) 524/2013, you may submit any dispute concerning this purchase to the European Commission's ODR Platform: https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is: tekkofitness@outlook.com.
5. Additional Rights for United Kingdom Consumers
If you are a consumer resident in the United Kingdom, you have the following statutory rights, which apply in addition to our commercial 15-day return policy.
5.1 14-Day Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel this contract within 14 days without giving any reason. The cancellation period expires 14 days after the day on which you acquire physical possession of the goods.
To exercise this right, you must inform us of your decision by means of a clear statement (e.g., email or letter). You may use the model cancellation form in the Annex, but it is not obligatory.
You must send back the goods within 14 days of telling us you wish to cancel. You will bear the direct cost of returning the goods, except where they are defective or not as described. You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.
We will reimburse all payments received from you, including the costs of standard delivery, within 14 days of receiving the goods back or evidence of return shipment, whichever is earliest. Refunds will be issued via the original payment method.
5.2 Consumer Rights Act 2015
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you are entitled to:
- a 30-day short-term right to reject the goods and receive a full refund;
- after 30 days, a right to repair or replacement;
- if repair or replacement is unsuccessful, a final right to reject for a refund or to receive a price reduction.
These statutory rights are in addition to our commercial return policy and cannot be excluded or limited.
6. Additional Rights for United States Consumers
If you are a consumer resident in the United States, our 15-day return policy applies as the contractual basis for returns. The following additional protections apply.
6.1 Posted Return Policy
This policy is conspicuously posted on our website prior to purchase, in compliance with applicable state laws including, where relevant, California Civil Code §1723, New York General Business Law §218-a, Florida Statutes §501.142, Virginia Code §59.1-200, and similar statutes in other States. By completing your purchase, you acknowledge that you have had the opportunity to review this policy.
6.2 California Consumers — Specific Notice
CALIFORNIA RETURN POLICY: Returns are accepted within 15 days of receipt of the item, in original condition, with all tags attached and in original packaging, accompanied by proof of purchase, in accordance with this policy. Defective goods are accepted at any time within applicable warranty periods.
6.3 Defective or Non-Conforming Goods
Under the Uniform Commercial Code as adopted in your State, goods sold to consumers are subject to an implied warranty of merchantability and, where applicable, an implied warranty of fitness for a particular purpose. To the maximum extent permitted by applicable law, these implied warranties are not excluded or limited by this policy.
If we provide a written warranty in connection with a consumer product, your rights under the federal Magnuson-Moss Warranty Act (15 U.S.C. §§2301 et seq.) are preserved.
6.4 FTC Mail, Internet, or Telephone Order Rule
In accordance with the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), if we are unable to ship your order within the time stated (or within 30 days if no time was stated), you have the right to consent to a delay or to cancel your order and receive a full refund.
6.5 Chargebacks
Nothing in this policy limits your rights under the Fair Credit Billing Act (15 U.S.C. §§1666 et seq.) or your card issuer's chargeback procedures.
7. Refund Processing Times
Once we have received and inspected your return, we will notify you whether the refund has been approved.
- Commercial returns (Section 1): approved refunds are processed within 10 business days through the original payment method.
- EU statutory withdrawal (Section 4.1): refunds within 14 days of being informed of your decision, subject to the right to withhold reimbursement.
- UK statutory cancellation (Section 5.1): refunds within 14 days of receiving the goods back or evidence of return shipment.
- US returns: refunds within 10 business days of return acceptance.
Please note that your bank or card issuer may require additional time to post the refund to your account.
If more than 15 business days have passed since your return was approved without you receiving the refund, please contact us at tekkofitness@outlook.com.
Refunds will be issued in the original currency of the transaction. Currency conversion fees, if any, charged by your bank or card issuer are not refundable.
8. International Returns
For returns shipped from outside the European Union (including the UK and the US), you are responsible for:
- return shipping costs (except where the goods are defective or not as described);
- any customs duties, taxes or fees incurred upon return.
We recommend using a trackable shipping service and considering shipping insurance, as we cannot be responsible for items lost or damaged in return transit.
9. Exchanges
The fastest way to make sure you get what you want is to return the item you have, and — once the return is accepted — make a separate purchase for the new item.
10. Governing Law and Mandatory Consumer Rights
This Policy is governed by the laws of Italy, without prejudice to any mandatory consumer protection rights that you enjoy under the laws of your country or state of habitual residence (in particular Article 6(2) of Regulation (EC) No 593/2008 — "Rome I" — for EU consumers, and equivalent protections for UK and US consumers).
Nothing in this policy limits or excludes any statutory consumer rights that cannot be limited or excluded under applicable law.
